Terms of Service
The terms governing our partnership. Clear conditions, fair dealings, and mutual respect — the foundation of every booking.
Scope & Definitions
These Terms of Service ("Terms") govern the business relationship between flyEurope DMC ("flyEurope," "we," "our," or "us"), a destination management company operated by FLYORA LLC (Shams Free Zone, Sharjah, UAE), and the travel trade professional or agency ("you," "your," or "Partner") engaging our services.
By submitting a booking request, signing a partner agreement, or using our services in any capacity, you agree to be bound by these Terms.
Key definitions
- "Programme" — any travel itinerary, tour, transfer, or ground service arranged by flyEurope on your behalf
- "Booking" — a confirmed reservation for a Programme, acknowledged in writing by flyEurope
- "Net rate" — the trade price quoted to you, exclusive of your retail margin
- "Supplier" — any third-party provider (hotel, transport company, guide service, etc.) engaged by flyEurope to deliver components of a Programme
- "Pax" — the number of travellers in a booking
B2B Only Services
flyEurope operates exclusively as a business-to-business service provider. Our services, rates, and materials are intended solely for licensed travel agents, tour operators, and accredited travel trade professionals.
- We do not accept bookings from individual consumers or end travellers
- You are responsible for your own client relationship, including pricing, communication, and after-sales service
- Our net rates are confidential and must not be disclosed to end travellers or third parties outside your organisation
- Any materials we provide (itineraries, images, descriptions) may be white-labelled under your brand but must not be attributed to another DMC
Quotes & Pricing
- All quotes are provided in EUR and are valid for 7 days unless otherwise stated
- Prices are based on supplier rates at the time of quoting and are subject to change until a booking is confirmed
- Quotes are based on the specific dates, group size, and services requested — changes to any of these may result in revised pricing
- Seasonal surcharges, local taxes, and city fees are included in our quotes unless explicitly stated otherwise
- Quotes do not include airfare, visa fees, travel insurance, personal expenses, or any services not explicitly listed
- Once a booking is confirmed, the quoted price is locked and will not increase unless you request changes to the programme
Booking & Confirmation
A booking is considered confirmed only when all of the following conditions are met:
- You have submitted a written booking request (email or partner portal)
- flyEurope has issued a written booking confirmation with a unique reference number
- The required deposit or full payment has been received (see Section 5)
Until all three conditions are met, availability remains subject to change. flyEurope is not liable for any costs incurred by you or your clients based on unconfirmed bookings.
You are responsible for verifying all booking details — dates, names, services, and special requirements — at the time of confirmation. Corrections requested after confirmation may incur additional charges.
Payment Terms
- A non-refundable deposit of 30% of the total programme value is required within 5 business days of booking confirmation
- The remaining balance is due no later than 45 days before the programme start date
- For bookings made within 45 days of departure, full payment is required at the time of confirmation
- Payment is accepted via bank transfer (SEPA/SWIFT). Credit card payment may be available subject to a processing surcharge
- All payments must be made in EUR unless otherwise agreed in writing
- Late payments may result in booking cancellation without refund of the deposit, and flyEurope reserves the right to suspend services until outstanding balances are settled
- flyEurope will issue invoices in compliance with Belgian VAT regulations
Changes & Amendments
We understand that travel plans evolve. Changes to confirmed bookings are handled as follows:
- Minor changes (room type upgrade, meal preference, timing adjustments) — we will accommodate where possible at no additional charge
- Material changes (date change, destination change, significant group size change) — treated as a new quote. Any price difference and an amendment fee of €50 per booking may apply
- Name changes — permitted up to 14 days before departure at no charge. Within 14 days, supplier policies apply
- Changes requested after departure — subject to supplier availability and pricing, with no guarantee of the original rate
All change requests must be submitted in writing. Verbal requests are not binding on either party.
Cancellation Policy
Cancellations must be submitted in writing. The following cancellation fees apply based on the notice period before the programme start date:
| Notice Period | Cancellation Fee |
|---|---|
| 60+ days before departure | Deposit forfeited (30%) |
| 30–59 days before departure | 50% of total programme value |
| 15–29 days before departure | 75% of total programme value |
| 14 days or fewer | 100% of total programme value |
| No-show | 100% — no refund |
- Certain suppliers (e.g. supercar experiences, peak-season hotels) may have stricter cancellation terms — these will be communicated at the time of booking
- Partial cancellations (reducing group size) are treated proportionally but are subject to minimum group size requirements
- Refunds, where applicable, will be processed within 30 business days of the cancellation being accepted
- flyEurope's own service fees are non-refundable in all cases
Supplier Arrangements
flyEurope acts as an intermediary, coordinating services from a vetted network of independent suppliers across Europe.
- Suppliers (hotels, transport providers, guides, activity operators) are independent contractors — they are not employees or agents of flyEurope
- We select suppliers based on quality, reliability, and value, and we conduct regular reviews
- In rare cases, we may substitute a supplier with one of equal or higher standard if the original is unavailable — we will notify you of any material substitution
- Supplier terms and conditions apply in addition to these Terms where relevant, particularly regarding on-site conduct, safety protocols, and local regulations
- Any complaints regarding supplier services must be reported to flyEurope within 7 days of the programme end date
Liability & Limitations
flyEurope exercises reasonable care and diligence in selecting and coordinating suppliers and services. However:
- flyEurope acts as an organiser and intermediary — we are not the direct provider of transport, accommodation, or activities
- We are not liable for loss, injury, damage, delay, or inconvenience caused by the acts, omissions, or negligence of any third-party supplier
- We are not liable for losses arising from your failure to provide accurate booking information, travel documents, or medical disclosures
- Our total liability for any claim arising from a booking shall not exceed the total fees paid to flyEurope for that specific booking
- We are not liable for indirect, consequential, or incidental damages, including lost profits or business disruption
- Nothing in these Terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by our negligence
Force Majeure
Neither party shall be liable for failure or delay in performing obligations caused by circumstances beyond reasonable control, including but not limited to:
- Natural disasters, extreme weather, or environmental events
- Pandemics, epidemics, or public health emergencies
- War, terrorism, civil unrest, or political instability
- Government actions, travel bans, border closures, or sanctions
- Strikes, labour disputes, or supply chain disruptions
- Infrastructure failures (power, telecommunications, transport networks)
In the event of force majeure, flyEurope will work with you and our suppliers to reschedule, reroute, or provide alternative arrangements where possible. Refunds in force majeure situations are subject to what can be recovered from suppliers — flyEurope will pass through any supplier refunds in full.
Insurance & Documentation
- You are strongly advised to ensure your clients hold comprehensive travel insurance covering cancellation, medical expenses, repatriation, personal belongings, and third-party liability
- flyEurope is not responsible for uninsured losses
- You and your clients are solely responsible for valid passports, visas, health certificates, and compliance with entry requirements of all countries on the itinerary
- flyEurope may provide general guidance on documentation requirements, but this does not constitute legal advice and we accept no liability for refused entry or deportation
Intellectual Property
- All content on flyeuropedmc.com — including text, images, itinerary descriptions, route maps, and design — is the property of flyEurope DMC or its licensors
- Partners may use programme descriptions and images provided by flyEurope for the purpose of selling those specific programmes to their clients
- White-labelling is permitted: you may rebrand our materials under your own agency brand. You may not attribute them to another DMC or supplier
- You may not reproduce, distribute, or commercially exploit our content for purposes unrelated to selling flyEurope programmes without written consent
- The flyEurope name, logo, and brand assets may not be used without prior written approval
Confidentiality
Both parties agree to treat the following as confidential:
- Net rates, commission structures, and pricing methodologies
- Supplier identities and commercial terms (unless publicly known)
- Client lists, booking volumes, and business performance data
- Proprietary systems, tools, and operational processes
Confidentiality obligations survive the termination of the business relationship for a period of 2 years. Breach of confidentiality may result in immediate termination of the partner agreement.
Data Protection
Both parties shall comply with applicable data protection legislation, including the General Data Protection Regulation (GDPR).
- Personal data shared between parties (traveller names, contact details, special requirements) shall be processed solely for the purpose of delivering the booked programme
- Neither party shall use the other's client data for unsolicited marketing without explicit consent
- For full details on how we handle personal data, please refer to our Privacy Policy
See our Privacy Policy for comprehensive details.
Complaints & Disputes
- Any complaints regarding services must be communicated in writing within 7 days of the programme end date
- flyEurope will acknowledge complaints within 3 business days and provide a substantive response within 21 business days
- We will investigate each complaint fairly and, where appropriate, offer remediation, credit, or compensation
- These Terms are governed by and construed in accordance with the laws of the United Arab Emirates
- Any dispute that cannot be resolved amicably shall be submitted to the competent courts of Sharjah, UAE
- Both parties agree to attempt mediation before pursuing litigation
General Provisions
- Entire agreement — these Terms, together with any signed partner agreement and booking confirmations, constitute the entire agreement between the parties
- Severability — if any provision is found unenforceable, the remaining provisions remain in full effect
- No waiver — failure to enforce any provision does not constitute a waiver of our right to enforce it later
- Assignment — you may not assign your rights or obligations under these Terms without our written consent. flyEurope may assign its rights to a successor entity
- Amendments — we may update these Terms from time to time. Material changes will be communicated to active partners with 30 days' notice. Continued use of our services after notice constitutes acceptance
